It is important to note that all bookings made by the Canary Travel are subject to the terms and conditions imposed by airlines, coach operators, hoteliers, and other third parties providing services including, but not limited to, shipping, rail, car hire, ferry, tour and restaurant operators whose services are used by the Company, some of which limit or exclude liability in respect of insolvency, non operation, death, personal injury, delay and loss or damage to baggage.

Canary Travel cannot accept any liability for the acts, omissions or default, whether negligent or otherwise, of airlines, car rental operators, ferry companies, hoteliers, tour operators or other persons providing services in connection with your tour pursuant to a contract between themselves and you (which may be evidenced in writing by the issue of a ticket, voucher, coupon or the like) and over whom Canary Travel has no direct or exclusive control. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control. Acceptance of any tickets, coupons, exchange orders, vouchers and receipts will be deemed acceptance of the above conditions and of any alterations made to your tour. Canary Travel reserves the right to decline acceptance of any individual on any tour.

We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements.

Payment

Credit cards cannot be used to purchase air tickets that will be collected outside Thailand. The travel/booking agent making payment must have an actual imprint of the credit card or process the actual credit card through their electronic terminal. This imprint / transaction slip must be signed by the cardholder. Payments may be made by cash, bank transfer or credit card. An administration fee will apply to balances paid by credit card. Fees are as follows: Visa/Mastercard /American Express/Diners 3% . No liability will be accepted by the Company until payment is actually received by the Company. Any binding contract will only exist between you and the Company when final payment has been made and all tickets, coupons, exchange orders, vouchers and receipts have been issued to you by the Company. The credit card holder must be one of the passengers traveling on the booking unless payment is made in cash.

Refunds for Unused Services

No refunds will be made for unused services where a client terminates the service after it has commenced regardless of reason.

Insurance

We strongly recommend full insurance against cancellation charges, baggage loss and medical expenses. (Travel Insurance covers numerous contingencies. There are, however, some exclusions including insolvency of airlines and some other operators, acts of terrorism and other acts of war).

Late Bookings

Every effort will be made to process late bookings. Bookings made less than eight weeks prior to departure from Thailand will require payments in full at the time of booking.

Amendment Fees

Any voluntary change of departure date and/or amendment of itinerary by client after acceptance will incur an amendment fee of 1000 baht together with any cancellation charges imposed by the hotel/cruises/airlines. Amendments made within 21 days of departure, full cancellation fees will be charged.

Surcharges

Please note that surcharges may apply during Christmas, New Year, Easter and Songkran and during conferences. Please check with our office for details. Not included in Tour Price: All items of a personal nature, such as telephone calls, laundry, beverages, excess baggage, gratuities, meals, etc.

Where refunds are due to you from third party suppliers of travel products or services, we will provide reasonable assistance to you in claiming such funds from those suppliers Prices are subject to change until full payment is received and are subject to travel service provider availability. A booking fee may be payable on some bookings. Some airport taxes are not pre-payable or pre-paid; you must pay these when required. Some airlines or travel service providers have introduced fuel surcharges which may not be reflected in the prices shown and will be an additional charge. For travel services such as air tickets, hotels, cars, packages or cruises-availability, prices, fare conditions and class of travel can change at any time without notice. Routing restrictions and other special conditions may apply.

Many countries require that foreign nationals entering hold a passport with at least six months validity remaining. This information as well as other related information supplied by Canary Travel and any links within the site are supplied in good faith; and should be treated as a guideline only. Passport, Visa (including transit visa/s) and health requirements are the responsibility of all individual travelers. The sole responsibility for ensuring travel documentation is correct is that of the individual traveler. We reserve the right to decline any booking or purchase for any reason and shall not be held liable for any resulting claims for loss, damages or compensation. You agree to bear the full cost of any booking, cancellation and administration fees for any products or services booked but not used for any reason.

CANCELLATION CHARGES:

We are unable to provide a refund to you until we receive the funds from the relevant supplier. Cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Fees will also apply where a booking is changed or tickets are reissued.

If the Passenger cancels his/her booking, cancellation charges will be charged according to the following scale.

More than thirty days (60 days for all group departures) prior to departure - forfeit deposit or 10% of the tour cost, whichever is greater.

Thirty days or less (60 days or less for all group tours) prior to departure - no refund.

In cases where full payment is required at time of confirmation (eg. Floating Market or River Kwai day trips) the full payment is not refundable.

All passengers must also comply with all legislation, visas, immigration, customs, foreign exchange and health regulations of the countries visited. It is the Passengers' responsibility to familiarise themselves with any/all health, entry/exit visa immigration, customs regulations and other documentation requirements that may be applicable to the areas that are to be visited. Passport, visa and vaccination requirements are not the responsibility of Canary Travel and Canary Travel will not be liable for any loss or expense due to the Passengers' (or their Travel Agents) failure to comply with the above. Any additional costs incurred (whether by the Passengers or by the Company on the Passengers' behalf) as a result of failure to comply with such requirements will be paid for by The Passengers.

The making of a booking constitutes the Passenger's acceptance of all booking terms and conditions as described herein and forms the basis of your contract with the Company.
